Responsibilities:
- Own all compliance programs, policies, procedures, internal controls, testing and reporting across the platform and the products it supports for lending partners
- Manage the compliance framework governing bank sponsorship relationships, including partner agreement terms, and serve as primary compliance liaison to the bank partner’s compliance and risk teams
- Develop and maintain the fair lending program, monitoring for disparate impact and disparate treatment across lending decisions, marketing and product design
- Ensure adequate BSA/AML controls, including CIP/KYC procedures appropriate to an online lending environment, in coordination with the bank partner
- Establish and maintain a robust UDAP/UDAAP program spanning marketing, origination, servicing and collections
- Ensure compliance with TILA, EFTA, E-SIGN, CAN-SPAM and applicable federal, state and tribal consumer lending law; review and approve customer-facing digital flows, disclosures, terms and consent language
- Monitor developments affecting bank partnership lending models – true lender, rate exportation and preemption – and lead regulatory change management against CFPB, OCC, FDIC and FTC rulemaking
- Oversee third-party and vendor compliance risk, including due diligence, ongoing monitoring and contractual requirements
- Provide oversight of the compliance management system: risk-based testing, training and complaint handling
- Manage document production and responses for external audits and regulatory examinations, including those run by or for the bank partner
- Advise the executive team and Board on risk and emerging compliance trends; support regulatory advocacy efforts
- Lead the compliance team and supervise outside counsel in consultation with the General Counsel
Requirements:
- Essential education: Bachelor’s degree – Preferred: Advanced degree (Masters, JD, etc.)
- You must have demonstrable senior level compliance experience in financial services, fintech or banking, including experience managing regulatory exams and external audits
- Prior experience with bank lending programs, online consumer lending or financial technology platforms strongly preferred
- Strong working knowledge of TILA, EFTA, E-SIGN, UDAAP, BSA/AML, fair lending laws and the CFPB regulatory framework
