We are representing a small commercial pharmaceutical company that is experiencing growth and is well funded by an international pharmaceutical parent who provides us autonomy.

Compliance Director/Senior Counsel Responsibilities:

  • Manages all processes that help ensure compliance with company policy, applicable laws and regulations, and industry guidelines governing interactions with Health Care Professionals (HCPs), including federal and state Anti-kickback statutes, the Food Drug and Cosmetic Act (FDCA), the False Claims Act (FCA), and the PhRMA Code
  • Creates, delivers and tracks compliance training through a combination of online tools and live training
  • Serves as Secretary of the company’s cross-functional Compliance Committee
  • Monitors compliance by performing routine analytics of relevant data and conducting field ride-alongs with sales professionals
  • Manages federal and state aggregate spend tracking and reporting (Sunshine Act / Open Payments)
  • Assists with conducting, tracking and reporting compliance investigations
  • Supervises compliance analyst

Compliance Director/Senior Counsel Requirements:

  • Law degree (JD) and active license to practice law in at least one state
  • Compliance position or Compliance Counsel position to life sciences company…preferably in-house;  will consider those currently in consulting
  • In-depth knowledge of the current federal and state pharmaceutical enforcement environment, including the federal Medicare/Medicaid Anti-kickback statute, False Claims Act, the Office of Inspector General (OIG) Model Compliance Guidance for Pharmaceutical Manufacturers, recent Corporate Integrity Agreements, PhRMA Code and state pharmaceutical marketing laws/regulations

Relocation Policy for Compliance Director/Senior Counsel:

  • Full relocation paid by company
  • May consider remote arrangement for those currently living within 400 miles of San Diego
